Information about Enbridge Class Action

A settlement agreement was recently reached in the Enbridge Class Action, as explained below.  If you worked for an Enbridge company and took a maternity, pregnancy or parental leave starting as early as 1988, you may be a Class Member. 

 

The Enbridge Class Action, brought by Sue Williams, alleges that Enbridge failed to properly administer the paperwork for parental leaves, resulting in lower pension service being awarded to a limited number of impacted persons.

 

Enbridge has denied all of these allegations.  The Court has not made any decision on the merits of those allegations in this Class Action. Instead, Ms Williams and Enbridge have reached a proposed settlement, which is subject to approval by the Court at a hearing on May 28, 2026. 

If you are a Class Member, your rights will be affected by this settlement. You have three choices:  you can choose to do nothing, in which case you will be bound by the outcome of the hearing for approval of the settlement; in the alternative, you have the right to support or to object to the proposed compensation plan and be bound by the outcome of the hearing for approval of the settlement; or in the further alternative, you have the right to instead refuse to participate in the settlement (that is, to “opt out of” the Class Action). 

 

If the settlement is approved, a smaller group of Class Members (the “Settlement Class Members”) will be eligible to make a claim for a payment under the terms of the settlement.  If you wish to learn more about the Class Action, the proposed settlement, and the steps you can take, we urge you to visit the following web page:

If you choose to opt out of the Class Action, you will not be eligible to receive any compensation from the settlement, if approved. You will instead reserve the right to try to make your own claim against Enbridge (subject to defences those companies may raise, including limitation defences) if you believe you are owed pension service accruals during a maternity, pregnancy, and/or parental leave during the period in question.  The decision to opt out should not be taken lightly, as it means that you would have to start your own claim at your own expense if you wanted to seek to recover any compensation from Enbridge.  You are advised to seek independent legal advice before choosing to take that step.
